Greetings Homeowners! 

The Board is happy to announce the voting results for the Fire Pit Proposal. You collectively and overwhelmingly voted yes for the firepits. However, this will not be official until filed and formally announced either on the website or at the next Homeowner’s meeting. In preparation for the release of this new amendment, we want to reiterate the Rules and Restrictions for the firepits. These will be very strictly enforced and fines will be assessed if any violations are commited. The Board will allow only two violations to be tolerated before the right to use a firepit is rescinded and your right to use the firepit will be strictly forbidden. Plantation Estates is more than 50 years old so most of the homes are similarly aged and therefore, more likely to catch fire, which is the reason for the zero tolerance fire policy in the Convenants & Restrictions. We are amending this policy but will still hold the restrictions for firepits in the highest regard to keep all homeowners safe from harm. Below is a preliminary set of Fire Pit Restrictions. Fire Pit Restrictions:

Every Fire Pit or Chiminea must be inspected by a board member for compliance prior to use.

The common  metal pits are best for meeting the requirements/restrictions. Pit must be at least 15” deep (measured from the top of the pit bowl to the ground, excluding the cover).

Pits must not exceed 36” across.

Pits must have a grated cover of non-flammable material. 

Pits must be placed on a non-flamable surface, so NOT on wood. You must place on concrete, pavers, grass or soil.

Chimeneas are self contained but also must be placed on a non-flammable surface.

Must be at least 10’ away from your home, fence and/or overhanging trees.

Fuel source for pits/chimineas may ONLY be wood, natural gas or propane gas. NOTHING additional may be burned in the pits. And by nothing, that means nothing but wood. No paper, leaves, yard waste, household waste…nothing except wood.

A hose or fire extinguisher must be kept near the pits in case of fire or embers escaping. 

Constant supervision by an adult is required!

Variances can be considered in special circumstances, which can only be granted by the Board.

Needless to say, all city, county and state government regulations and restrictions must be observed.

You must have proof of homeowners insurance in order to have your firepit or chiminea approved for use. 

The Board appreciates your cooperation with these restrictions in order to keep this amendment active! We anticipate many happy fire pit owners and we will keep you posted on the official release date for this amendment!
